Right of Withdrawal

(1) The Consumer have the right to withdraw from this contract within fourteen days without giving any reason.

(2) The withdrawal period will expire after fourteen days from the day,

[In the case of a sales contract]

  • a. on which the Consumer or a third party other than the carrier and indicated by the Consumer acquires physical possession of the goods, or

[In the case of a sales contract relating to multiple goods ordered by the Consumer in one order and delivered separately]

  • b. on which the Consumer or a third party other than the carrier and indicated by the Consumer acquires physical possession of the last good, or

[In the case of a sales contract relating to delivery of a good consisting of multiple lots or pieces]

  • c. on which the Consumer or a third party other than the carrier and indicated by the Consumer acquires physical possession of the last lot or piece.

(3) To exercise the right of withdrawal, the Consumer must inform the Supplier of his decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). The Consumer may use the attached model withdrawal form, but it is not obligatory.

(4) To meet the withdrawal deadline, it is sufficient for the Consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

(1) If the Consumer withdraws from this contract, the Supplier shall reimburse all payments received from the Consumer, including the costs of delivery (with the exception of the supplementary costs resulting from the Consumer’s choice of a type of delivery other than the least expensive type of standard delivery offered by the Supplier), without undue delay and in any event not later than 14 days from the day on which the Supplier is informed about the Consumer’s decision to withdraw from this contract.

(2) The Supplier will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of such reimbursement.

(3) The Supplier may withhold the reimbursement until he has received the goods back or until the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.

(4) The Consumer shall send back the goods or hand them over to the Supplier, in a clean condition where possible, without undue delay and in any event not later than 14 days from the day on which the Consumer communicates his withdrawal from this contract to the Supplier. The deadline is met if the Consumer sends back the goods before the period of 14 days has expired.

(5) Unless otherwise agreed by the Supplier, the Consumer shall bear the direct costs of retuning the goods.

(6) The Consumer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions from the Right of Withdrawal

(1) The right of withdrawal shall not apply to the supply of goods made to the Consumer’s specifications or clearly personalized.

(2) The right of withdrawal shall not apply to the supply of goods, which are liable to deteriorate or expire rapidly.

(3) The right of withdrawal shall not apply to the supply of sealed goods, which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

(4) The right of withdrawal shall not apply to the supply of sealed audio or sealed video recordings such as CD, DVD etc. or sealed computer software, which were unsealed after delivery.

(5) The right of withdrawal shall not apply to the supply of goods, which are, after delivery, according to their nature, inseparably mixed with other items.
